One important article of faith for some Muslim women is the Hijab - the head covering worn as a sign of modesty. Abercrombie & Fitch fired one Muslim lady for her refusal to take it off while she was at work. As a result, she's suing. In this video on CNN, she cites the 1st Amendment as granting her freedom of religion. However, some courts have found that the United States Bill of Rights and the Constitution grant those freedoms from the government - not from private businesses.
Your thoughts?
I think it's horse shit. I'm not sure how the law reads, but I personally think that employers should have the right to hire and fire who they want for whatever reason they deem appropriate. If the company says "Take it off" she should take it off or quit. It's that simple.
ReplyDeleteI'm with you. But how does one draw the line between allowing something like a hijab and discrimination?
DeleteI mean sure, it's her constitutional right to wear her hijab or burka in any public place she goes. However, when she's on my property it's my way or the highway. Why isn't this corporation's house given the same ownership of conduct on their property? Again, I don't know what kind of contracts they may have entered or exactly how the religious freedom rights are interpreted by modern court. I'm just expressing what I feel "should be".
